Pocket Proof — Disclaimer Addendum

This addendum supplements the Dignity Labs Base Disclaimer. It covers feature-specific limitations for Pocket Proof.

1. Evidence Capture — Not a Forensic Tool

Pocket Proof is a consumer application, not a forensic instrument.

While it implements published standards (SHA-256 for hashing, NIST SP 800-86 guidance for chain of custody), it has not been independently certified, accredited, or validated by any forensic science body, standards organisation, law enforcement agency, or regulatory authority.

Pocket Proof is designed to help you create records with stronger integrity characteristics than a standard phone recording. It does not guarantee that those records will meet the evidentiary standards of any particular court, tribunal, or proceeding.

2. Admissibility

Dignity Labs Ltd makes no representation or guarantee that recordings made with Pocket Proof will be accepted as evidence in any legal, regulatory, employment, insurance, or dispute resolution proceeding.

Admissibility depends on many factors beyond our control, including:

  • The jurisdiction and specific court or tribunal
  • The applicable rules of evidence
  • Whether recording consent was properly obtained
  • The relevance and probative value of the recording
  • Whether the opposing party challenges the recording
  • The opinion of the judge, arbitrator, or decision-maker
  • Whether proper chain of custody was maintained outside the App

If you intend to use a recording as evidence, consult a legal professional in your jurisdiction before doing so.

3. Recording Consent

You are solely responsible for complying with all applicable laws regarding recording consent.

Recording consent laws vary significantly by jurisdiction, situation, and the type of recording (audio, video, phone call). Some jurisdictions require the consent of all parties being recorded. Others require only one party's consent. Some locations prohibit recording entirely (e.g., certain courtrooms, government buildings).

Dignity Labs Ltd does not advise you on when or how to record. The guided capture templates in the App are a convenience feature, not legal guidance. Using a template does not guarantee that your recording is lawful.

If in doubt about whether you may legally record in a given situation, do not record. Seek legal advice first.

4. Hash Verification Limitations

SHA-256 hashing provides a cryptographic fingerprint that can demonstrate a file has not been altered since the hash was computed. However:

  • The hash proves the file has not changed — it does not prove what was recorded, by whom, or when
  • The hash is generated from the file as saved by your device's camera system; the App does not control how your device encodes video, audio, or images
  • If your device is compromised (rooted, jailbroken, or infected with malware), the hash may have been computed on a tampered file
  • The hash is not a legally recognised digital signature or notarisation
  • Hash verification within the App proves integrity within the App's ecosystem only — it does not constitute third-party verification

5. GPS and Timestamp Limitations

GPS Accuracy

GPS coordinates are reported by your device's hardware and location services. Accuracy varies by device, environment (indoor/outdoor), network conditions, and satellite visibility. The App reports the accuracy figure your device provides but cannot independently verify it. GPS coordinates can be spoofed on compromised devices.

Timestamps

Timestamps are taken from your device's system clock. If your device clock is inaccurate (manually set, wrong timezone, or not synchronised), timestamps will be inaccurate. The App does not use a trusted timestamping authority.

6. Chain of Custody Limitations

The chain of custody log records actions taken within the App (capture, view, export, share, delete). It does not track what happens to a file after it has been exported or shared. It does not record who performed the action (the App has no user accounts). It is maintained on-device only and is deleted if the App is uninstalled. It has not been validated against any forensic standard for chain of custody documentation.

7. Evidence Vault Limitations

The Evidence Vault (Pro feature) encrypts recordings at rest using AES-256-GCM with keys stored in your device's secure hardware. However, encryption does not guarantee admissibility. If you forget your PIN, encrypted recordings cannot be recovered. The vault protects against unauthorised access to your device, not against all threats. Dignity Labs Ltd cannot decrypt vault contents under any circumstances.

8. Data Loss

Pocket Proof stores all data on your device only. We have no backups of your recordings.

Your recordings may be permanently lost if: your device is lost, stolen, or destroyed; you uninstall the App; your device suffers hardware failure; you perform a factory reset; or free-tier auto-delete removes recordings after 24 hours (this applies after your 7-day free trial ends, unless you subscribe to Pro).

If a recording is important, export it immediately to a secure backup location. Do not rely solely on on-device storage for critical recordings.

9. Guided Capture Templates

Guided capture templates suggest recording structures for common situations. Templates are a convenience feature, not legal or professional guidance. Using a template does not guarantee compliance with any legal requirement. Template content may not reflect current law in your jurisdiction. You remain solely responsible for the content and legality of your recordings.

10. Trusted Contacts

Trusted contacts are stored on your device only. If you share a recording via a trusted contact, the recording leaves the App via your device's standard sharing functionality. Dignity Labs Ltd is not responsible for what happens to recordings after they are shared.
