Pocket Proof — App Addendum

This addendum supplements the Dignity Labs Base Terms of Service. By using Pocket Proof, you agree to both the base terms and this addendum. If there is any conflict, this addendum prevails for Pocket Proof.

P1. Description of Service

Pocket Proof is a mobile application for capturing timestamped, tamper-evident recordings. The App allows you to:

  • Record video, audio, and photos with automatic timestamps
  • Generate SHA-256 cryptographic hashes at the moment of capture to prove files have not been altered
  • Attach GPS location data to recordings (with your permission)
  • Maintain a NIST-compliant chain of custody log for each capture
  • Verify the integrity of recordings at any time by re-hashing and comparing
  • Export recordings with integrity metadata for sharing
  • Use guided capture templates for common situations (Pro feature)
  • Store recordings in an encrypted evidence vault (Pro feature)
  • Manage trusted contacts for quick sharing (Pro feature)

The App is designed to help individuals create reliable records of conversations, agreements, incidents, and events.

P2. Local-First Architecture

Pocket Proof is a local-first application. This means:

  • No accounts: The App does not require sign-in, registration, or any form of account creation
  • No cloud: Your recordings are stored on your device only. Nothing is uploaded to our servers or any third-party cloud
  • No network calls: The App does not communicate with any server during normal operation
  • No backend: Dignity Labs Ltd does not operate servers for Pocket Proof data

The only network activity occurs if you choose to export or share a recording using your device's standard sharing functionality, which is handled by your operating system and whichever app you share to.

P3. Pocket Proof-Specific Prohibited Use

In addition to the general prohibited uses in the base terms, you must NOT use Pocket Proof to:

  • Record any person without their knowledge or consent where required by applicable law (see Section P6)
  • Record in any location where recording is prohibited by law (including but not limited to courtrooms, certain government buildings, and restricted areas)
  • Create recordings for the purpose of harassment, intimidation, blackmail, or coercion
  • Fabricate, stage, or misrepresent events in recordings
  • Tamper with, alter, or misrepresent the integrity metadata generated by the App
  • Represent the App's hash verification as a legally certified digital signature or notarisation

P4. Free Trial and Free Tier

P4.1 Free Trial (7 Days)

All new users receive a 7-day free trial with full access to all Pro features. No payment is required during the trial. At the end of the 7-day trial, you may subscribe to continue using Pro features or continue using the App on the free tier.

P4.2 Free Tier (After Trial)

After the 7-day trial, the following features remain available for free:

P5.1 Pricing

Monthly Subscription: £5.99/month
Billed monthly. Auto-renews unless cancelled at least 24 hours before the end of the current billing period.

Annual Subscription: £49.99/year
Billed annually. Auto-renews unless cancelled at least 24 hours before the end of the current billing period.

Lifetime Purchase: £99.99 one-time
A one-time payment that provides Pro features without recurring charges. "Lifetime" refers to the operational lifetime of the Service — meaning for as long as Dignity Labs Ltd continues to make the App available. If Dignity Labs Ltd voluntarily and permanently discontinues the Service, no refund is owed. Temporary unavailability (including app store removal, maintenance, or service interruptions) does not constitute discontinuation. The lifetime purchase is non-refundable after 14 days (or such longer period as required by applicable consumer law).

P6. Recording Consent and Legal Requirements

IMPORTANT: You are solely responsible for complying with all applicable laws regarding recording consent in your jurisdiction.

P6.1 Consent Laws Vary by Jurisdiction

Recording laws differ significantly across jurisdictions. Some examples:

This table is for general awareness only. It is not legal advice and may not reflect current law. You must check the recording laws that apply in your specific location and situation before using the App.

P6.2 Guided Capture Templates

Pocket Proof may include guided capture templates that suggest consent prompts or recording frameworks. These templates are provided as a convenience only. They do not constitute legal advice. Using a template does not guarantee that your recording is lawful, admissible, or compliant with any particular legal requirement. You remain solely responsible for ensuring compliance with applicable law.

P6.3 Our Position

Dignity Labs Ltd does not advise you on when or how to record. We provide a tool. How you use it is your responsibility. We are not liable for any consequence arising from your failure to obtain required consent, your recording in a prohibited location, or your breach of any applicable recording, privacy, or data protection law.

P7. Evidence and Integrity

P7.1 What the App Does

Pocket Proof is designed to help you create records with strong integrity characteristics:

  • SHA-256 hashing provides a cryptographic fingerprint that can demonstrate a file has not been altered since capture
  • GPS location records where a capture was made
  • Timestamps record when a capture was made
  • Chain of custody logging records every action taken on a recording (capture, view, export, share, delete)
  • Device metadata records the make, model, and operating system of the capture device

P7.2 What the App Does Not Do

Pocket Proof does NOT:

  • Certify, notarise, or legally authenticate any recording
  • Guarantee that any recording will be admissible as evidence in any jurisdiction or proceeding
  • Provide a legally recognised digital signature
  • Verify the identity of persons in a recording
  • Determine the truthfulness or accuracy of recorded content
  • Replace professional forensic evidence capture tools used by law enforcement
  • Independently verify GPS accuracy beyond what your device reports

P7.3 Admissibility

Admissibility of recordings as evidence varies by jurisdiction, court, tribunal, and the specific circumstances of each case. Dignity Labs Ltd makes no representation or guarantee that recordings made with Pocket Proof will be accepted as evidence in any proceeding. Factors that may affect admissibility include (but are not limited to): how consent was obtained, the jurisdiction and forum, the relevance and probative value of the recording, whether the recording has been challenged as altered, the chain of custody, and the rules of the specific court or tribunal.

If you intend to use a recording as evidence, you should consult a legal professional in your jurisdiction before doing so.

P7.4 Integrity Limitations

The SHA-256 hash is generated from the file as saved on your device. You should be aware that:

  • The hash proves the file has not changed since the hash was computed — it does not prove what was recorded or when
  • GPS coordinates are reported by your device and are only as accurate as your device's hardware and location services
  • Timestamps are taken from your device clock, which may be inaccurate if manually set
  • If your device is compromised (rooted, jailbroken, or infected with malware), the integrity of all data — including hashes, locations, and timestamps — may be unreliable
  • The chain of custody log records actions within the App only. It does not track what happens to exported files

P7.5 No Forensic Certification

Pocket Proof has not been independently certified, accredited, or validated by any forensic science body, standards organisation, or regulatory authority. It is a consumer tool, not a forensic instrument. The hashing, timestamping, and chain of custody features are implemented following published standards (SHA-256, NIST SP 800-86 guidance) but have not been independently audited for forensic use.

P8. Pocket Proof-Specific Disclaimers

P8.1 No Legal Advice

Nothing in the App, its templates, its documentation, or its output constitutes legal advice. Pocket Proof is a tool. It does not tell you whether you should record, when you may legally record, how recordings should be used, or whether a recording will be useful in any particular situation.

P8.2 Additional Liability Exclusions

In addition to the exclusions in the base terms, Dignity Labs Ltd shall not be liable for:

  • Any loss arising from a recording being ruled inadmissible in any proceeding
  • Any loss arising from failure to obtain recording consent
  • Any loss arising from inaccurate GPS coordinates, timestamps, or device metadata
  • Any loss arising from corruption, loss, or deletion of recordings on your device
  • Any loss arising from reliance on hash verification to prove file integrity
  • Any consequence of exporting or sharing a recording with any third party
  • Any legal, regulatory, or professional consequence of making a recording

P8.3 Additional Indemnification

In addition to the indemnification in the base terms, you agree to indemnify Dignity Labs Ltd against claims arising from:

  • Your recording of any person without required consent
  • Your recording in any prohibited location
  • Your use or attempted use of any recording as evidence in any proceeding
  • Your sharing or distribution of any recording
  • Any claim by a third party arising from the content of your recordings

P9. Data and Storage

P9.1 Your Data, Your Device

All Pocket Proof data is stored on your device. Dignity Labs Ltd does not have access to your recordings, metadata, hashes, or any other data. If you delete the App or lose your device, your data is gone. We cannot recover it.

P9.2 Auto-Delete

Free tier recordings are automatically deleted after 24 hours. Pro users can configure their own retention period. Auto-delete is a device-level function — once deleted, recordings cannot be recovered by Dignity Labs Ltd or anyone else.

P9.3 Export and Share

When you export or share a recording, it leaves the App via your device's standard sharing functionality. Once shared, Dignity Labs Ltd has no control over the recording. You are responsible for how shared recordings are used, stored, and distributed.
